I, for myself and on behalf of the above-named Participant, hereby acknowledge that participation in the above-referenced Summer Camp (the “Program”) is elective and voluntary. In consideration of the Participant being permitted by Lebanon Valley College to participate in the Program, I hereby acknowledge and agree to the following:

1. ASSUMPTION OF RISK: I understand and acknowledge that there are potential dangers incidental to participation in the Program, including risks of damage, loss, disease, illness, injury, bodily harm or even death. The risks may result from: the Program itself, leisure activities, game-like activities, use of equipment, travel to, from, and during the Program, housing and services provided during the Program, conduct of other persons and participants, weather conditions, facility conditions, first aid, or unavailability of medical services. I acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time. I KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS, KNOWN AND UNKNOWN, ASSOCIATED WITH PARTICIPATION IN THE PROGRAM.

2. WAIVER OF LIABILITY: I AGREE TO RELEASE, WAIVE, FOREVER DISCHARGE, LEBANON VALLEY COLLEGE, including its governing board, trustees, directors, officers, employees, and any Participants, agents or volunteers acting at Lebanon Valley College’s direction (collectively referred to as "LVC"), for any and all claims or liability for injury or damage (including loss or damage to property and/or attorneys’ fees) that arises from participation in the Program, INCLUDING ANY CLAIMS OR LIABILITY THAT ARISES FROM THE NEGLIGENCE OF LVC, but not including any claims or liability that result from the willful conduct or gross negligence on the part of LVC.

3. INDEMNIFICATION: I, on behalf of myself and Participant, and our personal representatives, heirs, executors, administrators, agents, and assigns, agree to indemnify, defend, and hold harmless LVC from any and all liability, including any and all claims, demands, causes of action (known or

unknown), suits, or judgments of any and every kind (including attorneys' fees), arising from any injury, illness, damage or death that Participant may suffer as a result of participation in the Program.

4. PHOTOGRAPHY AND VIDEO RELEASE: I authorize Lebanon Valley College and those acting pursuant to its authority to record Participant’s likeness and voice in any medium, to use my child’s name in connection with these recordings, and to use, reproduce, exhibit, or distribute in any medium these recordings for any purpose that Lebanon Valley College deems appropriate, including promotional or advertising efforts. I release LVC from liability for any violation of any personal or proprietary right I or Participant may have in connection with such use. I understand that all recordings, in whatever medium, shall remain the property of Lebanon Valley College.

5. FORCE MAJEURE: I agree that LVC will not be liable for any failure or delay in providing the Program or any portion of it and no default or breach will have occurred, when and to such extent the failure or delay is due to circumstances beyond LVC’s reasonable control including without limitation, Acts of God, flood, fire, earthquake, explosion, loss of power, war, terrorist threat or act, protest or other civil unrest, external disruptions, pandemics or epidemics, labor disruptions, or official governmental or judicial action.

6. CONDUCT EXPECTATIONS: I understand that Participant will be required to follow all Program rules and reasonable directions from Program staff. I understand that weapons, alcohol, illegal drugs are prohibited on College property. I acknowledge that Lebanon Valley College has the right to suspend, dismiss, or remove Participant from the Program for serious misconduct as determined in the discretion of Lebanon Valley College.

I certify that I am the Parent or Legal Guardian of the above-named Participant. I HAVE READ THIS LIABILITY WAIVER, RELEASE OF CLAIMS, and OTHER IMPORTANT TERMS AND FULLY UNDERSTAND AND AGREE TO ITS TERMS. I AM AWARE THAT THIS AGREEMENT INCLUDES AN ASSUMPTION OF RISK, A WAIVER OF LIABILITY, AN AGREEMENT TO INDEMNIFY and other important terms
